Section B: General Terms (All Clients)

These terms apply to all clients, including NDIS and private participants.

1. Client Responsibilities

• Attend scheduled appointments on time and be willing to leave at the scheduled end time

• Notify us of any risks (e.g. pets, visitors, family violence orders) for home visits, Mute or switch off phones/devices during sessions

• Children must remain supervised in waiting areas

• It is the clients' responsibility to cancel ongoing appointments if they are not required over school/ holidays

2. Therapist Responsibilities

• Be prepared for sessions and endeavour to run on time

• Provide a safe, confidential, and respectful environment

• Disclose information only when required by law or duty of care

3. Safety, Confidentiality & Duty of Care

We are legally and ethically required to report:

• Serious risk to yourself or others

• Suspected abuse or neglect

• Matters under subpoena or legal order

For children and vulnerable clients, safety takes precedence over family preferences under child protection legislation.

4. Waiting Room & Child Supervision

Children must be accompanied and supervised at all times in the waiting area. After the session, children must be collected promptly. If children are not met after session and we have made every effort to contact guardian(s) we may notify the Department for Child Protection. For safety reasons we may lock the external door at our Elizabeth office, if you are a support person or parent/carer waiting for a participant who is in session and plan on leaving the premises, please ensure you inform your therapist of your plans.

5. Health & Safety Information

Clients (or their carers/representatives) are responsible for disclosing any relevant health conditions, allergies, or medical needs on the Intake Form and keeping AkindaCo informed of any changes. This includes information that may impact therapy participation or safety (e.g. epilepsy, diabetes, anaphylaxis, sensory sensitivities). Failure to provide accurate or updated information may affect our ability to deliver services safely and effectively.

6. Ending Therapy

You may end therapy at any time, we recommend providing with 2 weeks’ written notice (email to admin is accepted) to allow planned ending / transition. Clients are encouraged to attend an ending session to conclude work safely. AkindaCo may terminate services if there is violence, harassment, or threats toward staff, or repeated no-shows or late payments. Referrals to alternative services will be offered if possible.

7. Holidays & Breaks

Therapists will give notice of upcoming leave. As a guide both clients and therapists are asked to give 2 weeks’ notice for planned absences when possible. If your allocated therapist is on leave for longer than 2 weeks we will offer you the choice to work with another therapist during your allocated therapist's absence.

Clinical questions will not be addressed via email, text, or SMS. These must be discussed in session with your therapist for privacy and safety.

9. Private Clients & MHCP Rates

A completed intake form required 5 days prior to first appointment. Initial sessions are 90 minutes. Credit cards are charged 30 minutes into the session.

MHCP Discount:

• AkindaCo offer a $60/hour discount (on private fees only) with a valid Mental Health Care Plan. You are able to access as many sessions as needed within a 6 month time period of your MHCP starting. If you require additional information regarding our MHCP scheme please ask for the MHCP information sheet from our admin team.

9. Client Agreement

By signing your Intake Form and/or Service Agreement, you confirm:

• You understand and accept AkindaCo’s terms & conditions

• You acknowledge your rights regarding privacy, safety, and complaint processes

• You agree to pay fees for services rendered, including late or defaulted payments

Client Agreement

By signing the terms and conditions, you also agree that mistakes made by referring parties of billing details (such as identifying a client as plan-managed when they are in fact NDIA managed), that you as the client are liable to pay outstanding fees to AkindaCo. We endeavour to work with your support team to manage this, however you will be liable for any outstanding charges if we are unable to charge a suitable plan management agency.

I have read the preceding information and understand my rights and responsibilities as a client. My signature below acknowledges this understanding and indicates I accept the conditions of service provision at AkindaCo. As your service provider, AkindaCo Pty Ltd will comply with relevant Federal and State privacy legislation, the NDIS (Quality Indicators for Practice Standards) Guidelines 2018 with respect to privacy, confidentiality and dignity, and the Australian Privacy Principles with respect to dealing with personal information related to the provision of services and supports as a registered NDIS service provider.

Whenever required we will work closely with other individuals, disability service providers, community and mainstream services and other government agencies/departments in helping you to achieve the best possible outcomes with respect to your NDIS Plan, any other current support plans with respect to available funded supports.

Your informed consent to permit AkindaCo Pty Ltd to share information will be sought and respected in all situations, unless:

• We are obliged by law to disclose your information regardless of consent or otherwise

• It is unsafe or impossible to gain consent or consent has been refused

• Without information being shared, it is anticipated that a person with a disability will be

at risk of serious harm, abuse or neglect, or pose a risk to their own or public health or

safety

We collect information about you so we can provide quality supports and services to you. We need to collect some personal information from you to make sure we are meeting your support needs. We will only collect personal information about you, which is relevant to provision of our supports, including any recorded material in audio and/or visual formats. You can contact us at any time to arrange access to your information and make any changes.
